Read This Carefully

Assumption of Risk – As the parent or guardian of the registered minor or dependent or as myself or my spouse, I assume full responsibility for the decision for my child/dependent to participate in Hard Court Sports LLC Tennis/Pickleball. I also assume full responsibility for the decision for myself/spouse to participate in Hard Court Sports LLC Tennis/Pickleball programs. I acknowledge that participation by myself and/or my dependent(s) in the activities listed above may entail known and unanticipated risks, which could result in physical injury, death or property damage. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity. These risks may also occur as a result of my dependent(s) or my own actions, inactions or negligence, as well as actions, inactions or negligence of others, weather conditions, condition of equipment, condition of the facilities and grounds, natural disaster, national disaster, and any first aid emergency treatment which may be administered. Special note for pickleball participants: The pickleball court is a small court that is only 20 feet wide and 44 feet long. When playing be aware of surrounding objects including but not limited to, the nets, net posts, light poles, fencing, etc. You must be aware of your surroundings and take the utmost caution while you are on the court regardless of whether you are playing or observing. Make certain you are able to stop before running into an object. There may also be other risks that are not foreseeable at this time.

Release – As part of the consideration for myself and/or my dependent(s) participating in the activity identified above, I release, discharge, and hold harmless Hard Court Sports LLC, Halecrest Park INC and any director, officer, employee, or any person acting in any capacity on their behalf from all demands, causes of action, suits contracts, agreements, obligations, covenants, defenses, costs, liabilities and judgments, whatsoever, known or unknown, suspected or unsuspected, in contract or in tort, in law or in equity, which I might have against Hard Court Sports LLC of Halecrest Park INC, arising from my child/dependent’s participation in the Programs.

Waiver and Indemnification – I hereby waive all claims and demands against Hard Court Sports LLC and Halecrest Park INC for any loss, damage, injury (including death) or claim of any kind arising from, related to or caused by myself or my dependent’s participation in the Programs and agree to indemnify, defend, and hold harmless Hard Court Sports LLC and Halecrest Park INC from all loss, liability, damages, costs, and expenses (including actual attorney’s fees) arising from or related to same.

Photography/Video - In permitting myself/my dependent(s) to participate, I understand that myself/my dependent(s) photograph/video may appear in publicity or brochures marketing Hard Court Sports LLC Tennis programs. I understand that there are no rights granted to me or my dependents to inspect or approve photographs/video prior to publication.

Lesson Policies - Wear proper athletic clothing (no jeans). Wear proper tennis shoes. Silence cell phones and place them off to the side of the court preferably in a bag during class. Behavior that detracts from the class (including, but not limited to dangerous behavior, bullying, language, etc.) will not be tolerated and will result in removal from class without refund. Parents or Guardians please arrive no later than 5 minutes after class ends to pick up your child(ren). If you arrive more than 5 minutes late and the instructor is forced to wait for you to arrive, you will be charged the private lesson rate by the minute. This fee will be payable directly to the instructor. Minimum class participation is 3. If a class enrollment is smaller than 3 the class may be cancelled (and a refund or credit issued), it may be combined with another class. The instructor also has the discretion to shorten the duration of the class by up to 1/2 the time.

Missed Classes/Other Policies – No make ups allowed for missed classes. No exceptions. There will also be no refunds for missed classes. No exceptions. If an instructor cancels a class for any other reason a credit for future classes will be issued. No prorations for missed classes. For Group Tennis Lessons: When enrolling in recurring (or auto book) classes your card will automatically be charged the next billing cycle starts or up to 3 days before.  New billing cycles start on the first day of every month.  Cancellations can be done in your online account at any time.  Please note that when you cancel a participant their spot is immediately removed from the roster.  You can also cancel by emailing us but we must receive your email at least 10 days before the end of the month to allow for time to process the cancellation.  To cancel immediately, just sign into your account, go to your enrollments and click on the link to cancel your class(es). For All Lessons: Absolutely no refunds for any classes/missed month(s) for any reason unless proper cancellation notice was given (see previous sentences).

COVID-19 WARNING - By visiting Halecrest Park you and your child(ren) voluntarily assume all risks related to exposure to COVID-19. You will be entering a place with other people which presents an inherent risk of exposure as with any other public place. You must follow all posted instructions while visiting the park, and follow all California laws and CDC guidelines pertaining to COVID-19. According to the CDC COVID-19 is extremely contagious. Most who contract the disease recover with only mild symptoms. Senior citizens and participants with underlying medical conditions are more vulnerable. If you or anyone in your household is exhibiting any symptoms related to COVID-19 you may not enter the park. Follow federal, state, and local laws with regards to masking and social distancing requirements. Maintain 6 feet of social distancing at all times. Halecrest Park is a Private Club - Access to the club is for registered participants, and Halecrest members. If you are not a member of the club the only facilities you are able to use are the tennis/pickleball courts (during your lesson only) and the bathrooms. Siblings, friends, your children, etc. are not permitted to use any features of the club (ie. playground, basketball court, etc.). After your tennis lesson is over you are required to make your way out of the club in a timely manner (sorry, but we've had people staying for hours after their lessons and bringing friends etc.). Please don't "hang out" more than necessary or you will be asked to politely leave. Entering the club is at your own risk. Management assumes no liability for any accidents/injury.

Refunds - Unless otherwise stated there are no refunds for any tennis or pickleball classes, private lessons, monthly enrollments, academy classes, camps, etc. no exceptions.

Exceptions:

Tennis and Pickleball Camps - Full refund less 10% up to two weeks before camp start date (the 10% covers our processing fees) or you can choose a credit and we will return 100% as an account credit or credit for future classes.  50% refund up to one week before camp start date, or you can choose a credit and we will return 100% as an account or credit for future classes.  No refunds will be processed within 1 week of camp start date, no exceptions.

Pickleball Academy Courses - Full refund less 10% up to two weeks before course start date (the 10% covers our processing fees). A 50% refund will be issued up to one week before course start date. Or, you can choose a credit and we will return 100% as a credit for future classes. No refunds will be processed within 1 week of course start date, no exceptions.

Special Events (Tournaments, Round Robins, etc.) - Full refund less 10% up to two weeks before event start date (the 10% covers our processing fees) or you can choose a credit and we will return 100% as an account credit or credit for future classes.  50% refund up to one week before event start date.  No refunds will be processed within 1 week of event start date, no exceptions.

Cancellations Due to Bad Weather - If weather forces a cancellation of a class/lesson you will be notified by text or email. Please keep an eye on your messages and make sure our do not go to your spam. For cancelled tennis classes a credit will be issued to your account. There will be no refunds to your original form of payment for bad weather cancellations. No exceptions. Tennis drop ins will be rescheduled to the next available class and can be rescheduled further by using the link in your “appointment rescheduled” email. Private lessons for both tennis and pickleball will be rescheduled to a time that works for both the client and instructor. Please contact your instructor directly. Pickleball lessons will be rescheduled to the next class with available space. These can also be rescheduled using the link in your “appointment rescheduled” email.

You must notify us by email of your cancellation request.

OTHER TERMS AND CONDITIONS FOR PICKLEBALL CLASSES/PICKLEBALL CLASS PACKS

Single Class Booking Policies - Also referred to as “one-off” or “drop-in” classes (in other words any class that was not booked with a package credit). Once you book your class and pay no refunds will be given for any reason, absolutely no exceptions. IMPORTANT: These appointments can be “rescheduled” and you will not lose your payment as long as it is done 24 hours or more in advance. However if you “cancel” your appointment you will no longer be able to reschedule it. If this happens by accident please email us and we can help you as a one time courtesy reschedule your appointment.

Class Packs - Once you purchase your class pack you will be issued credits which you can use to begin booking your classes. If you cancel a class it will be credited back to your account (as long as it is not within 24 hours of your scheduled time). You can also reschedule your classes. Cancelling and rescheduling is done by click on the link in your appointment confirmation email. Absolutely no refunds after your class pack is purchased for any reason, no exceptions. Once your class pack expires unused credits also expire. No extension will be given after class pack expiration, unused credits do not carry forward, and will not be refunded for any reason, absolutely no exceptions.

OTHER TERMS AND CONDITIONS FOR PRIVATE LESSONS/PRIVATE GROUPS

Payment - All private lessons are to be paid in full PRIOR to the start of the lesson or first lesson in a package.  If a lesson is not paid for at the time of lesson or first lesson in a package you will be charged to the card on file for the package or lesson you chose.  No refunds will be given on private lessons within 24 hours of lesson time or after the lesson has started or is completed.  No exceptions.

Cancellation Policies - If for any reason you need to cancel or reschedule a lesson, 24 hours notice is required. Refer to your confirmation email for a link to cancel or reschedule your lesson, or email, call/text your pro directly. All lessons cancelled or rescheduled less than 24 hours prior to the scheduled day/time will be charged the full lesson rate to the card on file. For package holders the lesson will be deducted from the package. One emergency cancellation (less than 24 hour notice) per household will be forgiven without charge. No shows will be charged the full lesson (or if a package was purchased) rate to the card on file.

Package Expiration - All private lesson packages unless otherwise specified expire 365 days from date of purchase. Refer to specific expiration date when a coupon is used.

Term - I have read this Agreement and agree to be bound by its terms. This Agreement shall be effective for all tennis/pickleball programs/classes in which I and/or my dependent participates.
